Terms and Conditions

These Terms and Conditions (“Terms”) apply to all quotations, products, and services provided by CrispyRed Group Pty Ltd (ABN 49 675 752 244) trading as Evolved Floors (“we”, “us”, “our”). By accepting a quote, paying a deposit, or engaging our services, you (“the client”) agree to these Terms in full.

Nothing in these Terms limits or excludes any rights you hold under the Australian Consumer Law.

1. Our Services

Evolved Floors provides flooring supply and installation services across Gold Coast, Byron Bay, Brisbane, and surrounding regions, including:

  • Hybrid SPC flooring
  • Vinyl plank and sheet vinyl
  • Engineered timber flooring
  • Solid timber flooring
  • Carpet supply and installation
  • Laminate flooring
  • Acoustic wall and ceiling panels
  • Floor preparation and subfloor works

All services are subject to site assessment, product availability, and acceptance of a written quotation.

2. Quotes & Pricing

  • Quotes are valid for 30 days from the date of issue, unless otherwise stated
  • Prices are based on visible site conditions at the time of quoting
  • Additional costs may apply where subfloor conditions, moisture levels, or structural issues differ from initial assessment
  • All prices are in AUD and exclude GST unless expressly stated otherwise
  • Any variation to the agreed scope must be approved in writing before work proceeds
  • Evolved Floors reserves the right to withdraw or revise a quote if material costs change significantly before acceptance

3. Payment Terms

  • A deposit of 50% is required to secure your booking and order materials
  • The remaining 50% is due 24 hours prior to installation
  • We accept bank transfer (EFT), credit card, and approved finance
  • Late payments beyond 7 days of the due date may incur interest and debt recovery costs
  • Ownership of all goods remains with Evolved Floors until full payment is received. We reserve the right to recover goods in the event of non-payment
  • Where staged invoicing is agreed, each stage must be paid before the following stage commences

4. Client Responsibilities

You agree to:

  • Provide safe, clear, and unobstructed access to the work area on the agreed date
  • Remove all furniture, appliances, and personal items unless furniture removal is included in your quote
  • Ensure all other trades (plastering, painting, wet areas, cabinetry, etc.) are fully complete before installation commences
  • Ensure adequate ventilation and stable indoor temperature (16–27°C) during and after installation
  • Ensure the subfloor meets required standards prior to our arrival, unless subfloor preparation is included in your quote
  • Disclose any known moisture issues, previous flooding, underfloor heating, or structural concerns prior to commencement

Delays, downtime, or additional work caused by failure to meet these responsibilities may result in additional charges.

5. Subfloor & Moisture

  • Unless moisture mitigation is specifically included in your quote, responsibility for subfloor moisture management remains with the client
  • We are not responsible for damage caused by undetected or undisclosed moisture, rising damp, or inadequate vapour barriers
  • Where moisture readings exceed acceptable thresholds on the day of installation, we reserve the right to pause works and provide a variation for additional preparation — this does not constitute a breach of contract
  • Subfloor flatness tolerance: maximum 3mm over a 1.8m span for most floating floor products. Additional levelling charges apply where this is not met

6. Installation Standards

  • Installation is carried out in accordance with relevant Australian Standards and manufacturer specifications
  • Standard installation includes trims, scotias, and expansion gaps as required
  • Minor variations in colour, shade, grain, or texture between boards, batches, or samples are a natural characteristic of flooring products and do not constitute a defect
  • Installed products may show colour variation under different lighting conditions
  • Any visible defects must be reported in writing within 48 hours of completion. This requirement applies to defects identifiable at the time of practical completion. Latent defects (those not apparent at completion) and your rights under the Australian Consumer Law are not subject to this reporting window

7. Warranties

7.1 Product Warranty

All products are covered by the manufacturer’s own warranty, which varies by product and brand. Manufacturer warranties are subject to each manufacturer’s own terms and conditions, available from the manufacturer directly. Installation and maintenance requirements specified by the manufacturer must be followed to maintain manufacturer warranty eligibility. Warranty documents are available upon request or from the manufacturer’s website.

7.2 Workmanship Warranty

We provide a 12-month express workmanship warranty on all installation work, covering defects directly attributable to our installation.

This express warranty does not cover:

  • Wear and tear from normal use
  • Damage caused by moisture, flooding, or water ingress
  • Structural movement or subfloor subsidence
  • Damage caused by third parties, including other trades
  • Improper cleaning, maintenance, or use of non-approved products
  • Pet damage, stiletto heels, heavy furniture without protective pads
  • Any work carried out by parties other than Evolved Floors after installation

This 12-month express warranty is in addition to any rights you hold under the Australian Consumer Law, which are not limited to this period.

7.3 Licensed Subcontractor Work

Where installation work is performed by licensed subcontractors engaged by Evolved Floors (for example, glue-down timber installations requiring a QBCC licence), those subcontractors hold the applicable licences and the statutory warranties associated with that licence attach to the licence holder. Evolved Floors warrants that any such subcontractors are appropriately licensed for the work performed.

8. Actions That Void Our Express Warranty

Your Australian Consumer Law rights are not affected by this section

The following conditions apply to the express workmanship warranty and manufacturer product warranty described above. They do not affect any rights you hold under the Australian Consumer Law, which apply independently of and in addition to these warranties.

The following client actions will void our express warranty for the affected area:

  1. Applying silicone sealant to any floating floor — silicone prevents natural expansion and contraction, causing buckling, lifting, and joint failure. Floating floors must never be siliconed at the perimeter, joins, or against fixed objects
  2. Sealing or blocking expansion gaps — all floating floors require perimeter expansion gaps. Covering or restricting these gaps will cause floor failure
  3. Installing fixed cabinetry, islands, or heavy fixed structures directly on top of a floating floor without allowing the floor to move freely beneath
  4. Wet mopping or steam cleaning any floating floor product, unless the manufacturer expressly permits it
  5. Failing to maintain indoor humidity within the product’s specified range (typically 35–65% RH)

9. Ongoing Maintenance Obligations

To maintain your express warranty, you must:

  • Clean with a dry or barely damp mop only, using a pH-neutral flooring cleaner
  • Use furniture pads or felt protectors under all furniture legs
  • Place doormats at all entry points to prevent grit and abrasive debris on the floor surface
  • Avoid prolonged exposure to direct sunlight without UV-rated window coverings
  • Maintain stable indoor humidity levels (35–65% RH is recommended for most engineered and hybrid products)
  • Never use abrasive cleaners, bleach, ammonia, oil soaps, or wax products on floating floor surfaces

Failure to follow these maintenance requirements may void our express warranty but does not affect your rights under the Australian Consumer Law.

10. Cancellations & Refunds

  • Cancellation before materials are ordered: deposit refunded less administration fee of $150
  • Cancellation after materials are ordered: deposit forfeited to cover restocking fees and freight; restocking fees are typically 15–25% of materials cost depending on the supplier
  • Custom, special-order, or clearance products are non-refundable once ordered, except where the product fails to comply with the consumer guarantees under the Australian Consumer Law, in which case your statutory rights apply
  • Approved refunds are processed within 14 business days

11. Variations & Scope Changes

  • Any changes to the agreed scope of work must be approved in writing (email or signed variation) before additional work proceeds
  • Verbal instructions do not constitute approval of variations
  • Additional works will be charged at our current standard rates

12. Delays & Force Majeure

  • Installation dates are estimates only and may change due to product availability, weather, or site readiness
  • We are not liable for delays caused by supplier delays, shipping disruptions, or events outside our reasonable control
  • Where a client-caused delay results in a return visit being required, a call-out fee may apply

13. Limitation of Liability

To the maximum extent permitted by law:

  • Evolved Floors is not liable for indirect, consequential, or economic loss. This limitation does not apply to claims arising under the Australian Consumer Law, where our liability is governed by that legislation
  • Our total liability in connection with any claim is limited to the value of the works directly giving rise to the claim
  • We are not liable for pre-existing or hidden site conditions not disclosed or visible at the time of quoting
  • We are not liable for damage to adjacent areas or surfaces where reasonable care has been exercised

Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law.

14. Defects, Claims & Inspections

  • All defect claims must be made in writing with supporting photographs
  • We must be given the opportunity to inspect before any remediation work is undertaken
  • Unauthorised repairs or rectification work carried out by a third party will void our express workmanship warranty for the affected area
  • We aim to respond to defect notifications within 5 business days

15. Dispute Resolution

  • We aim to resolve all concerns quickly and fairly. Please contact us first at info@elfloors.com.au
  • If unresolved, disputes may proceed to mediation before legal proceedings
  • For residential disputes in Queensland, the Queensland Civil and Administrative Tribunal (QCAT) provides an accessible dispute resolution pathway

16. Privacy

We handle your personal information in accordance with the Australian Privacy Act 1988. Your information is used solely for the purposes of providing our services and meeting our legal obligations. We do not sell your information to third parties.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.

18. Updates

We may update these Terms at any time. The current version is always available at evolvedfloors.com.au/terms.
